How a headshop works in Spain: legal framework, products and business model
What is a headshop and how does it differ
A headshop is a specialist retail store selling smoking paraphernalia. It does not sell psychoactive substances — that would be a dispensary (illegal) or a coffeeshop (illegal in Spain). It sells the accessories and tools related to the act of smoking.
🍃 Headshop / Smokeshop
Sells paraphernalia: papers, filters, grinders, bongs, pipes, lighters, rollers. Legal in Spain. Does not sell substances.
🌿 Growshop
Sells growing equipment: seeds (collector’s), substrates, lighting. Legal in Spain with grey area.
🌈 CBD Shop
Sells hemp products with CBD (<0.2% THC): flowers, oils, cosmetics. Legal for cosmetic/technical use.
☕ Smartshop
Sells legal psychoactives (herbs, mushrooms). Dutch concept. Wide grey area. Rare in Spain.
The legal framework in Spain
The sale of smoking paraphernalia is not prohibited in Spain. Article 36.16 of the LOPSC (Gag Law, 2015) punishes public consumption or possession — the user, not the seller of the object.
Headshop products are legal because they are objects, not substances. A grinder is a tool. A bong is a water pipe. Rolling paper is paper. The object itself is not illegal. Responsibility lies with the user, not with whoever sells the object.
What a headshop can legally sell
Rolling papers
Standard, king size, slim, hemp, unbleached.
Filters and tips
Cardboard, slim, biodegradable, activated carbon.
Grinders
All materials and numbers of chambers.
Lighters
Clipper, BIC, butane, personalised.
Bags and storage
Airtight bags, jars, storage containers.
CBD / hemp
Flowers, oils, cosmetics with <0.2% THC.
What it cannot sell
- Cannabis (THC >0.2%): illegal without medical prescription
- HHC and synthetic derivatives: banned since April 2025 (Order SND/380/2025)
- Schedule I/II substances: any controlled narcotic
- Explicit cannabis advertising: cannot market products as “for marijuana”

Rolling papers and filters are the bread and butter of the headshop. A smoker can go through 1–2 booklets and 100+ filters a week. The purchase recurrence is what makes the business profitable — not the occasional sale of a premium grinder.
The headshop and CBD in 2026
CBD (<0.2% THC) is legal for cosmetic and technical uses. HHC and its derivatives have been banned since April 2025 (Order SND/380/2025). Medical cannabis is dispensed only at regulated pharmacies.
The future of the sector in Spain
As European regulation advances, demand for quality accessories grows. The modern artisan smoker wants unbleached hemp paper, activated carbon filters, an aluminium grinder. The headshop positioned around quality and product knowledge has the edge over one competing on price alone.
