To understand Prague in 2026, you need one key distinction: decriminalisation is not the same as legalisation. The Czech Republic has taken enormous steps, but it has not opened a regulated retail market. Understanding this difference could be the difference between an enjoyable trip and an unpleasant surprise.
Since 1 January 2010, possession of small quantities for personal use was classified as an administrative offence (not criminal). Under that regime, up to 15 grams of dry cannabis or cultivation of up to 5 plants was a simple fine, not a crime.
Then 2025 brought the biggest reform in history. Parliament passed a Criminal Code amendment on 30 May 2025; the Senate confirmed it on 3 July; President Petr Pavel signed it on 17 July 2025. The law took effect on 1 January 2026. The Czech Republic became the fourth EU member state to decriminalise personal possession and home cultivation, after Malta, Luxembourg, and Germany.
Public possession: up to 25 grams of dry cannabis — administrative offence, not a crime.
Home possession: up to 100 grams — permitted for adults aged 21+.
Home cultivation: up to 3 plants per adult — legal for those aged 21+.
Still prohibited: commercial sale of THC cannabis. No dispensaries, no licensed cannabis clubs in 2026.

HHC and derivatives
HHC was banned on 16 March 2026. Both sale and possession are punishable.
